In understanding the Ning Terms of Service it is important that we understand the many terms used by them. One definition often leads to some other term, which in turn needs explaining.)

  • Ning offers a platform for creating your own Social Networks (“Platform”).
  • Platform is like your toolbox or your clay which you use to create things.


Social Networks or Networks

  • Ning, the platform, is used to create social networks. The networks consist of features of your choice and may relate to anything -- your profile, friends, comments, recommendations, forums, photo sharing, video sharing, reviews, ratings, people matching, and events.


Users

  • You and others are users and you either create you own network or visit some exiting network. You can post content in either your own or somebody else’s network.

Network Creators

  • If you create a network, you are the network creator. Network creators have some privileges.


Code

  • Code is like computer language (PHP or html for example) used for creating social networks. You may have your own code or Ning may provide you one ready made. Network creator may also decide which is a Public Code (one that may be viewed, copied or used by others), or a Private one (which can’t be viewed etc by others.)
  • Making some code private requires the Premium service.


Content

  • Network creator can make the network public or private. Public content is available to all users whether from that network or not. Private content is, you know private, available to users of that network only.
  • Your content remains your property, but Ning has the right to make it available to others or to modify it.

Licenses to code

  • Permission to create codes is a license, which could again be public or private. Network creator designates them, but Ning may also modify the categorization. Public codes are for anybody to use, so you should only upload a code about which you are not secretive. The Private codes require a paid premium service. Your private code will be distributed only for making your network available on Ning platform.
  • Private content also implies permission to Ning to publicly display your content on that network.
  • Unless you clearly indicate, your content is public content.

Others

  • Your content will be deleted if you cancel your membership.
  • You can freely copy, distribute or transmit the Ning content. It can also be modified (“adopted to work”). But you have to clearly indicate the source and the use must be non-commercial.
  • You have to be registered with Ning for creating Network. But each Network creator will decide whether you can contribute content without registration with Ning.
  • All web based interaction requires some precaution. You should be similarly careful on Ning also.
  • Ning is not liable for any loss caused to you, including by disclosure of your personal details by one of the users.
  • You own all responsibility and free Ning and its owners/employees from any risk of suits for damages.
  • If you are a resident of California, you even waive away the protection of California code section 1542.
  • If you opt for premium services, you agree to pay the applicable fees also.
  • Network creators are responsible for fighting the virus noticed on their networks.
  • You will also comply with quotas for bandwidth, or face suspension.
  • You can run third party ads for payment of a fee to Ning. But Ning may insist on providing a “comparable” service
