  • "If you do not agree to these terms, do not click 'agree', and do not use the service." Apple, owner of this site, may "permit" you to purchase downloads etc. only if you accept these conditions.
  • If you are between 13-18 years old, you need approval of your parent/guardian to join iTunes. iTunes (and its owner Apple) are not liable if you come across offensive or indecent content. (2) & (3)
  • Your account may be terminated if your information is not correct or current. (7)
  • You are responsible for confidentiality of your account, and you can't use somebody else's account. (8-a)
  • Updating your hardware required for using content purchased is your responsibility, as itunes may suddenly change the requirements. (4 & 9-b)
  • "Any burning (if applicable) or exporting capabilities are solely an accommodation to you", and not a right. It is for personal use. You can burn an audio play-list upto 7 times, and can store items on your ipod from upto 5 accounts. (9-b)
  • Apple may change or discontinue the service whenever it wants. It will not be liable for your inability to enjoy the products purchased from iTunes. (9-d)
  • You are responsible for content posted by you, but iTunes has the right to use it any way it likes without paying you. (9-e)
  • Don't use the service if you are not in the United States! (10)
  • Apple may charge your credit card/Paypal for your purchase and any additional amounts due. (11)
  • If you do not receive a product despite payment, your only remedy is to wait for Apple's decision whether it agrees to replacement or refund as determined by Apple. (12)
  • Apple may change, suspend, remove, or disable access to any products, content etc at any time without notice. (13-b)
  • Apple may also allow you to download covers for albums. (13-e)
  • Apple may suspend your membership without notice if it 'suspects' any violations, but you have to pay for usage upto that point. (14-a)
  • You have to obey all laws whether local, national or international. (15)
  • Apple may take all steps to ensure compliance with these conditions. It may disclose your personal information to authorities or any third party "as Apple believes is reasonably necessary or appropriate to enforce and/or verify compliance with any part of this Agreement." (16)
  • "Your use of, or inability to use, the service is at your sole risk", unless laws of your state exclude such waivers. (18-b)
  • Nobody connected with Apple is liable for any loss/damage connected to use or inability to use of itunes, even if they were warned about it. (18-c)
  • Laws of California and its courts have exclusive jurisdiction. (22)
